1. Introduction

Welcome to GoatFitwear ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of the website goatfitwear.com (the "Site") and any purchases made through it. By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

3. Products

We sell sportswear and related apparel under the GoatFitwear brand. We make every effort to display product colors, sizes, and details as accurately as possible, but slight variations in color may occur due to monitor settings. Product availability is not guaranteed and may change without notice. We reserve the right to limit quantities, refuse orders, or discontinue products at any time.

4. Pricing and Payment

All prices on the Site are listed in the relevant local currency and include VAT where applicable. Shipping costs are calculated at checkout and shown before payment. We reserve the right to correct any pricing errors and to cancel orders made under an obvious mistake (for example, a clearly incorrect price). Payment is processed securely through Shopify Payments and our third-party providers. By submitting an order, you authorize us to charge the payment method provided.

5. Orders and Order Confirmation

Once you place an order, you will receive an automatic confirmation email. This confirmation acknowledges receipt of your order but does not constitute acceptance. The contract between you and GoatFitwear is formed only when we send a shipping confirmation. We may refuse or cancel any order for reasons including but not limited to product unavailability, errors in pricing, or suspicion of fraud.

6. Shipping and Delivery

Shipping times and costs are detailed on our Shipping page. Estimated delivery times are indicative and not guaranteed. Risk of loss passes to you upon delivery. If a shipment is delayed, lost, or damaged in transit, please contact us so we can help resolve the issue.

7. Right of Withdrawal (EU Consumers)

If you are a consumer based in the European Union, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason, in line with EU Directive 2011/83/EU. To exercise this right, please contact us within the 14-day window. You then have an additional 14 days to return the goods. Items must be unworn, unwashed, in original condition, and with all tags attached. Return shipping costs are the responsibility of the customer unless the product is defective or incorrect. The right of withdrawal does not apply to custom-made or personalized items, sealed hygiene products that have been opened (such as sports bras worn against the skin where hygiene applies), or items clearly marked as final sale.

8. Returns and Refunds

Refunds are processed to the original payment method within 14 days of us receiving the returned item, provided the return meets the conditions in our Return Policy. We may withhold the refund until the goods have been received or you have shown proof of return.

9. Defective or Incorrect Items

If you receive a product that is defective, damaged, or incorrect, please contact us within 14 days of delivery with photos and your order number. We will arrange a replacement, repair, or refund in accordance with applicable consumer protection law.

10. Intellectual Property

All content on the Site, including the GoatFitwear name, logo, designs, graphics, photographs, text, and product designs, is the property of GoatFitwear or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or use any content for commercial purposes without our prior written consent.

11. User Conduct

You agree not to use the Site for any unlawful purpose, to interfere with its operation, to attempt to gain unauthorized access, or to submit false or misleading information. We reserve the right to suspend or terminate access for any user who violates these Terms.

12. Limitation of Liability

To the fullest extent permitted by law, GoatFitwear is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products. Our total liability for any claim related to a product is limited to the amount paid for that product. Nothing in these Terms limits liability that cannot be excluded under applicable law, including statutory consumer rights.

Your personal data is processed in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR).

14. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. If you are a consumer, you also benefit from any mandatory provisions of the law of your country of residence. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise. EU consumers may also use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
